What is a Family Based Visa?
The Immigration and Nationality Act (INA) allows for foreigners to immigrate the to the United States based upon their relationship to a citizen of the United States. Family-based Immigrant Visas can occur under two categories: UNLIMITED and LIMITED:
How to apply for residency of a family member?
The process depends upon if your relative is living abroad or currently in the United States. If you are an American citizen or permanent resident you may be able to sponsor a family member.
Who is eligible for the unlimited family visas?
Close relatives of United States citizens, also referred to as Immediate Relatives (IR) may not be required to wait in line for to become eligible. The spouse, unmarried children under the age of 21 and parents over the age of 21 are considered to be a IRs.
How are limited visas allocated.
First preference or F-1, is given to IRs of U.S. citizens, F-2 is allocated to Permanent Residents IRs. F-3 is allocated to married sons and daughters and the spouse and children of U.S. citizens and F-4 is allocated to married children, their spouses and children of permanent residents.
